Job Description

Function Overview

As the senior-most leader for the company’s Legal Department in China, you will be working for a global company headquartered in the UK, coordinating with the region’s senior leadership teams and reporting to the global General Counsel. You will be a senior leader helping guide regional operations and responsible for providing guidance on key laws and regulations in Asia, with a focus in mainland China. You will play the primary role in negotiating and drafting the region’s contracts, managing legal and regulatory risk management and developing, in coordination with group Compliance, the region’s policies & procedures. You will be a key part of China's leadership team, partnering with the company’s senior and executive leaders in employee oversight and engagement, client servicing and product offerings. You will also act as the Data Protection Officer of the company in China.

 

Your responsibilities will include but not be limited to:

●        Support the region’s senior leadership team in their coordination and engagement with the company’s executive leadership team

●        Play a critical role in the region’s oversight, including the scheduling and hosting of China town halls & executive, investor visits

●        Serve as a critical regional point of contact for the company as to government engagement and regulatory interaction

●        Serve as the Head of Legal, China, interfacing and supporting APAC business and operations

●        Liaising and coordinating engagements with external counsel in China

●        Engaging, as needed, with local regulatory bodies and in coordination with the global Legal team

●        Ensuring that the global Legal team and General Counsel are appropriately advised on legal and regulatory matters in China

●        Identifying and mitigating legal risks across the China region and working with the business to assess business risks and controls, particularly as they relate to the legal and regulatory landscapes impacting the region and company operations

●        Helping to draft, vet and negotiate contracts, e.g., sales, marketing, NDAs, vendors, property leases and content distribution

●        Ensuring all contracts, legal documents and templates are up-to-date and compliant with local laws

●        Working collaboratively with global Legal team and General Counsel to align regional legal risk management and improve efficiencies across the Legal team

●        Working collaboratively and closely with the Compliance team on a cross-functional skills basis

●        Sales team contract negotiations with Clients and Brokers

●        Managing local company and business filings in China

●        Supporting operational managers with dispute management

●        Coordinating with the Head of Legal in the UK and local and global HR advising in respect of employee disputes, restrictive covenant disputes and investigations in Asia

●        Managing and responding to both local internal and external legal inquiries

●        Coordinating with regional compliance with local laws and sanctions regimes and advising on the legal implications of company policies and procedures in China

●        Maintaining the Company Chop and responsible for China Chop Policy

●        Dealing with the governmental affairs and providing the relevant policies of our business in China

 

Data Protection

●        Acting as DPO in China

●        Updating and maintaining PIPL policies

●        Advising the business on the impact of data privacy laws on procedures and new products

●        Coordinating with the company’s global Legal team as you and they engage, as necessary, with regulators

●        Responding to client and specialist queries and complaints

Qualifications

●        Excellent communication skills both written and verbal in English and Mandarin

●        10-12+ years previous legal experience and executive engagement

●        Strong commercial acumen and contract negotiation skills

●        Experience and knowledge of PIPL

●        Proven experience of working in a senior capacity in-house for a global company

Strong operational experience, a plus
